1. Acceptance of Terms
By accessing or using the LabourID platform (the "Service"), creating an account, or completing a purchase, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use our Service.
You must be at least 18 years of age and legally capable of entering into contracts under South African law. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Description of Services
LabourID provides workforce identity verification services including, but not limited to:
- SA ID number verification against the national population register
- Biometric identity verification (face match and liveness detection)
- Company and director verification via CIPC
- AML/PEP and sanctions screening across 190+ countries
- Employment history, consumer trace, and vehicle verification
- Bank account verification
Verification checks are processed through our licensed data providers. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. Pricing is subject to change with reasonable notice.
3. User Accounts
- You must provide accurate and complete information when registering
- You are responsible for maintaining the confidentiality of your password
- You must notify us immediately of any unauthorised access to your account
- Accounts inactive for more than 12 months may be deactivated
- You may not transfer your account to another person without our written consent
4. Permitted Use
You may use the Service solely for the following lawful purposes:
- Verifying your own identity to build a LabourID trust profile
- Conducting employee or contractor due diligence with proper consent from the subject
- Fraud detection and prevention in connection with your legitimate business operations
- KYC/AML compliance as required by applicable law
You remain solely responsible for having a valid lawful basis under POPIA for every verification you conduct, and for documenting that basis. LabourID does not make this determination on your behalf.
5. Prohibited Use
Violation of any prohibited use may result in immediate account termination and may expose you to civil or criminal liability.
You may not use the Service to:
- Conduct unlawful surveillance or stalking
- Discriminate on the basis of race, gender, religion, disability, or any other protected characteristic
- Build consumer profiles beyond the stated and lawful verification purpose
- Resell, redistribute, or sublicense verification results or API access without written permission
- Process personal information of minors without verified parental consent
- Circumvent privacy rights or consent requirements
- Transmit malware, viruses, or any code designed to harm our systems
- Attempt to reverse-engineer, scrape, or extract data from our platform
- Submit false or fraudulent information
- Use the Service in any way that violates POPIA, FICA, the NCA, the ECTA, or any other applicable law
6. Payment & Refunds
Payment
All amounts are stated in South African Rand (ZAR) and are inclusive of VAT where applicable. Payments are processed by PayFast. We do not store card details.
Refund policy
- Verification checks that have been successfully initiated are non-refundable, as the cost of querying the data source is incurred at submission
- Where a check fails due to a technical error on our side, a credit will be issued to your account
- Disputes must be raised within 30 days of the transaction by emailing billing@labourid.com
Pricing changes
We reserve the right to adjust pricing. We will give at least 14 days' notice of price changes for existing customers.
7. Accuracy of Verification Results
Verification results depend on the accuracy and completeness of data held by government agencies and licensed third-party data providers. We make no warranty, express or implied, as to the accuracy, completeness, or reliability of any verification result.
Verification results must not be used as the sole basis for any decision, including employment decisions, credit decisions, or legal proceedings. You must apply independent judgment and comply with all applicable laws when acting on a result.
LabourID does not provide credit decisions and is not a credit bureau or credit provider.
8. Intellectual Property
All content, software, designs, trademarks, and technology on the LabourID platform are owned by or licensed to LabourID (Pty) Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purposes only.
You may not reproduce, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, consequential, or punitive damages
- Our total liability in connection with the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) R1,000 ZAR
- We are not liable for inaccuracies in data provided by government sources or third-party data providers
10. Indemnification
You agree to indemnify and hold harmless LabourID, its directors, employees, and agents from any claims, losses, liabilities, damages, or expenses (including legal fees) arising from:
- Your breach of these Terms
- Your misuse of the Service or verification results
- Your violation of any applicable law, including POPIA
- Any claim by a third party arising from your use of verification results
11. Termination
Either party may terminate the agreement at any time. We may suspend or terminate your account immediately, without notice, for breach of these Terms or applicable law. Upon termination, your right to use the Service ceases immediately. Sections 8, 9, 10, and 12 survive termination.
12. POPIA Compliance
Both parties acknowledge their respective obligations under POPIA. As a customer using our verification services, you are the responsible party for the purposes of verifications you initiate, and LabourID acts as your operator/data processor.
- You must have a valid lawful basis for each verification request
- You must not process results for a purpose incompatible with the stated purpose
- You must implement appropriate security measures to protect results you retain
- You must comply with data subject access and deletion requests relating to results you hold

13. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South Gauteng High Court, Johannesburg, unless referred to alternative dispute resolution by agreement.
